Three Idaho dairies plan to appeal the verdict in a case they brought against the Northwest Dairy Association over milk sales, according to a Capital Press article.

Aardema Dairy, Bettencourt Dairies and Golden Valley Dairy filed a lawsuit four years ago against their co-op for taking a speculative position in the market with the milk the dairies had forward contracted with the organization.

The Capital Press article quoted the dairymen's attorney, Ken Pedersen, as saying that the co-op "had a responsibility to get our consent to make money off our milk. Profits were made without our permission."

The jury denied the dairymen's claims.

Pederson said that there is a reasonable chance for a successful appeal based on the judge's instructions to the jury.  PD
