Three yogurt companies are breathing a sigh of relief after emerging victorious in a legal battle over the definition of “yogurt.”

Dannon,General Mills, andCabot Creamerywere all targeted in separate class action lawsuits alleging their products were misbranded, according to Elaine Watson in an article forFood Navigator-USA.

One target was Dannon’s Activia, which plaintiff Kristie Conroy, in a filed complaint against the yogurt company last September, alleged was “not made the way yogurt is supposed to be made.”

Plaintiffs complained that the yogurt companies included milk protein concentrate and/or whey protein concentrate, which they said are not permitted in yogurts and not generally recognized as being safe.

Dannon, however, argued that the FDA, which has primary jurisdiction over such matters, has permitted the use of MPC in yogurt for 30 years and that plaintiffs’ complaints that MPC is a health risk in yogurt is not backed by any evidence. PD
